Congress May Vote This Week to Expand Surveillance Under Section 702 of FISA

The measure extends the government's authority to collect communications from foreigners, without warrants, including those communicating with USA citizens, under the Foreign Intelligence Surveillance Act's Section 702. But privacy advocates oppose the law, arguing there are not enough limits on the government's ability to scour the database of collected information for the communications of Americans in touch with those foreign targets.

A competing measure to enhance greater protections for Americans' privacy by requiring warrants was rejected earlier.

On Thursday morning, President Trump published a confusing tweet that seemed to question his administration's position on the matter.

Sens. Mike Lee (R-Utah) and Patrick Leahy (D-Vt.), the co-sponsors of previous 702 reform legislation, issued a joint statement Thursday calling on further deliberation in the Senate on privacy measures. Rand Paul (R-Ky.) says he intends to block any such legislation in the Senate. Trump tweeted. There's no real basis for that kind of accusation, one that was taken with alarm and bewilderment by those in his own administration.

The House on Thursday passed a renewal of a key foreign surveillance program, even though President Donald Trump sent mixed signals by complaining it was used to "badly surveil and abuse" his campaign and then reverting to his support for it. In the past, some lawmakers had made attempts to put into place some privacy limitation in the program mainly because it looks through the private communications of Americans such as emails, texts and phone calls.

Ryan emphatically described a "firewall" that existed before September 1, 2001 that prevented American intelligence agencies from having necessary information for national security. "This vote is about foreign surveillance of foreign bad guys on foreign land", he tweeted.

While Trump's displeasure stemmed from his understanding that FISA was used in the creation of Christopher Steele's famed Trump dossier, the act is more generally used to pursue foreign terrorists.

The new version of Section 702 voted for in the House yesterday would also allow a restart of controversial "about" data collection, which was ended past year after criticism from the FISA court.

Section 702 of the Foreign Intelligence Surveillance Act is set to expire on January 19. Justin Amash, R-Mich., and Zoe Lofgren, D-Calif., that would have required federal agents to get warrants before searching through Americans' data.

In 1978, the court that began giving out those permission slips was consolidated into a single, purpose-made entity: the Foreign Intelligence Surveillance Court (FISC).

"This is about foreign terrorists on foreign soil", Ryan said.

He later reversed course, after reports that he spoke to House Speaker Paul Ryan, and tweeted support of the bill, telling lawmakers to "Get smart!"

Another change included in the bill temporarily stops the collection of communications that mention a surveillance target, but aren't to or from that target.
