The apex court had directed senior advocate Harish Salve, representing Maharashtra, to give a copy of the documents to the petitioners.

The counsel for the petitioners said they wanted clarification on the date of hearing of the petition in the wake of the order passed by a bench of Justices Arun Mishra and MM Shantanagoudar.

Recusal comes after four senior SC judges accused CJI of assigning important cases to benches headed by junior judges.

Poonawalla and Lone's petition called the death of judge Loya "questionable, mysterious and contradicting".

Meanwhile, a petition filed by the West Bengal government, challenging mandatory Aadhaar number in the Income Tax returns, has also been appended on Tuesday when the Constitution Bench resumes hearing on Aadhaar.

The petition was mentioned before the chief justice's court on January 19, and Chief Justice Misra ordered that it should be put before an appropriate bench as per roster.

Justice Arun Mishra's January 16 order, fuelling apprehensions over him hearing the case again came a day after he broke down at a morning tea meet of SC judges where he expressed his anguish at being collateral damage in the fight between the four senior judges and the CJI because their allegations cast aspersions on his abilities.

The issue of Loya's death had come under the spotlight in November previous year after media reports quoting his sister had fuelled suspicion about the circumstances surrounding his death and its link to the Sohrabuddin case.

The two public interest litigations (PILs) demand an independent probe into the death of special CBI judge BH Loya. Judge Loya's doctor sister Anuradha Biyani raised questions on his death in a Delhi magazine in November, bringing into focus the death buried as heart attack. Shah was subsequently discharged from the case.

Singh, who has been appearing for the Medical Council of India in medical college bribery case, had written a letter to five seniormost judges-Justices J Chelameswar, Ranjan Gogoi, M B Lokur, Kurian Joseph and A K Sikri alleging that a group of activists under the banner of CJAR were trying to "scandalise the judiciary" by levelling "false charges" against the CJI.
