Dallas Mavericks owner and tech billionaire Mark Cuban has denied a sexual assault allegation from 2011 that resurfaced this week in a report by Willamette Week, a weekly alternative newspaper in Portland, Ore.

"Cuban then pushed his hand down the back of her jeans and inside her underwear where he cupped his hand over her groin area and inserted the tip of his finger into her vagina", McGuire wrote of her allegation, noting that the alleged victim did not report the incident to police for more than a week because she did not want to be "labeled "that girl" and involved in a sex scandal with Mark Cuban".

The Multnomah County District Attorney's Office didn't press criminal charges due to a lack of evidence, the Willamette Week reported.

Houze ordered a polygraph test conducted by former Miami Police Detective Sgt. Warren Holmes days after Cuban spoke with McGuire, and the results supported Cuban's denial.

"I really left it in the past", she told Jaquiss. "I stand behind that report 1,000%".

"This incident never happened and her accusations are false", Houze said.

The revelations come two weeks after Sports Illustrated detailed years of sexual harassment and misconduct allegations within the Dallas Mavericks' organization.

Yet a friend of the woman also reportedly told officers that Cuban was "very drunk ... his eyes were half closed, he was unstable on his feet, and he was slurring his words".

A detective in the case described two of the photos as "significant" in his report, according to Willamette Week. "In one of the pictures, his arm can be seen behind [the alleged victim] and it appears Cuban is reaching down toward her buttocks".

Police also reviewed seven photographs taken of the woman and one of her friends standing next to Cuban at the time. "The complainant requested documentation and investigation of her complaint but has confirmed with me she will not participate in a criminal prosecution and agrees her claim can not be proven". They provided written opinions claiming that it would have been impossible for Cuban to penetrate the woman's vagina with his finger given the circumstances of the alleged incident.

In a report explaining why they weren't pursuing the case, prosecutors wrote that 'there is no evidence to corroborate the complainant's statement and there is evidence contradicting the claim'.
