If those options are exhausted, authorities must find the "least restrictive" setting for a child who arrived without parents. It remains unclear what will happen with the more than 2,300 children separated from their parents at the border in recent weeks. Immigration officials must assess their claims, which can be time-consuming, but federal courts have ruled that the children can be held no longer than 20 days.

On Monday, Colorado Gov. John Hickenlooper banned state employees and resources from supporting any federal practices that separates families due to their immigration status, saying the Trump administration's policy was offensive and ran counter to Coloradan values.

McCain tweeted Monday night that the administration has the power to rescind this policy and "should do so now".

Many Christian leaders have rejected Sessions' interpretation of Romans 13 and spoke out against the zero tolerance policy, including the Council of Bishops of the United Methodist Church. "If you cross this border unlawfully, then we will prosecute you".

With the adult detained and facing prosecution, any minors accompanying them are taken away.

Earlier Monday he tweeted: "It is the Democrats fault for being weak and ineffective with Boarder Security and Crime". Under current law, it is not legal to detain whole families who cross the border illegally.

Addressing criticism by church leaders of the administration's "zero tolerance" immigration policy, the former Alabama senator cited the "clear and wise command" of the Apostle Paul in the 13th Chapter of Romans "to obey the laws of the government because God has ordained them for the objective of order".

The policy places adults trying to cross the border into custody, and places children in detention centres.

Similarly, 2016 Democratic presidential nominee Hillary Clinton said the Trump administration's policy is creating "a moral and humanitarian crisis", and that "every human being with a sense of compassion and decency should be outraged".

The Rev. David Wright, who spearheaded the complaint against Sessions, told USA Today that he hoped Methodist pastors could get Sessions to see the harm he is doing to immigrant children and persuade him to change his mind. Some of the other organizations are the American Civil Liberties Union, Young Center For Immigrant Children's Rights, Asylum Seeker Advocacy Project, Kids In Need of Defense, and so on. "Collectively, as former United States Attorneys, we have prosecuted tens of thousands of cases involving far more serious crimes than misdemeanor illegal entry offenses".

Sessions' speech Monday closely mirrored that of Department of Homeland Security (DHS) Secretary Kirstjen Nielsen, who also spoke at the same Sheriffs' Association event and doubled-down on the administration's new policy. Both are frequent critics of President Donald Trump and have been outspoken on other immigration issues.
