He most recently sided with conservatives in the court's decision to uphold the constitutionality of President Trump's travel ban.

"With this vacancy, Donald Trump and Mitch McConnell hold the balance of the court in their hands - and with it, the legal right to access abortion in this country", Planned Parenthood said in a statement.

At a White House meeting to discuss Mr Trump's proposed border wall he lauded the decision as "a tremendous success".

The 5-4 ruling rejected the argument that the ban represented unconstitutional religious discrimination.

"The ruling shows that all of the attacks from the media and the Democrat politicians are wrong, and they turned out to be very wrong", Trump said.

The often raw and unfiltered messages sent out from the Trump White House strike a stark contrast with the more controlled and traditional messaging strategies used by previous administration's.

"One is whether the president has an authority to say that there are countries that whose visa vetting systems we don't trust and therefore we're not going to allow people to come in, and another whether it's a good idea".

"In this era of worldwide terrorism and extremist movements bent on harming innocent civilians, we must properly vet those coming into our country", he said.

Chief Justice John Roberts wrote Tuesday that Trump's most recent version of the travel ban is consistent with both immigration law and the country's First Amendment.

Gorsuch already has demonstrated that he is one of the most conservative members of the court, aligning himself with Justices Clarence Thomas and Samuel Alito.

Justice Kennedy, 81, will retire on 31 July, per his letter to Mr Trump.

Writing in dissent, Justice Sonia Sotomayor said, "a reasonable observer would conclude that the Proclamation was motivated by anti-Muslim animus".

While Trump insisted the Supreme Court ruling on the ban was "vindication", Alrubyee labeled the policy something else altogether.

It also affects two non-Muslim countries, blocking travelers from North Korea and some Venezuelan government officials and their families. Those restrictions were not challenged in court.
