Over five and a half years after the 2012 Delhi gang-rape case shook the conscience of the nation, the Supreme Court will decide Monday whether the four men responsible for this heinous crime must be hanged.

"There is no material to review our order", said three judges led by Chief Justice of India Dipak Misra, on the review petitions of Mukesh, 29, Pawan Gupta, 22 and Vinay Sharma, 23. The fourth death row convict, Akshay Kumar Singh (31) did not filed a review petition against the order of the Supreme Court dated May 5 2017.

The court also observed that the convicts failed to point out the error in the judgement.

The accused, Mukesh Singh, Vinay Sharma, Akshay Thakur, and Pawan Gupta, along with two others, brutally beat, tortured, and raped a 23-year-old paramedical student, Jyoti Singh, on a moving bus, before leaving her bleeding on the side of the road late in the night. She succumbed to injuries on December 29, 2012 at Mount Elizabeth Hospital in Singapore.

A fifth man - the suspected ringleader - was found dead in jail in a suspected suicide, while a 17-year-old was sentenced to three years in a detention centre and has since been released. Not only this, a Madhya Pradesh court has recently awarded death sentence in a case of rape of a minor girl. To this, the court observed that the submission that death penalty has been abolished by the UK Parliament, several Latin American countries and Australia "is no ground to efface the death penalty from the statute book of our country".

The four men have maintained their innocence but only three appealed to have their death sentences lifted. Time and again her parents have demanded death penalty for all the rapists, including the juvenile.

Amnesty International suggested that instead of awarding capital punishment, the government should allocate adequate resources for improving the implementation of laws, improve the conviction rates and ensure certainty of justice in all cases.

The accused had then put up a clever masquerade with three of them posing as passengers in the bus when the victim and her friend, who were trying to get to Dwarka, were lured into the bus by the juvenile at the Munirka bus stop.

Following the 2012 case, India launched fast-track courts and a tougher rape law in April this year that included the death penalty for rape of girls below 12.
