The decision to conduct the draw in private on Tuesday morning, hours earlier than expected, was made by the thoroughbred racing industry body to "circumvent any security risks".

The apology comes as the Change-org petition pushing support for Herron and for the Opera House to remain "billboard free" now has more than 235,000 signatures and was delivered to NSW state parliament this morning. The Sydney Opera House initially rejected the proposal but a state official overruled and allowed a revised 10-minute projection of the ad for October 9.

"The use of the Opera House for the commercial advertising of this event is a completely unsatisfactory and is an inappropriate use of this significant heritage place", council chair Stephen Davies said in a letter to the premier on Tuesday.

Protester Joshua Richardson, 19, said he had no problem with the Opera House being lit up in the "right context" but said this illumination was "horrible".

"The Opera House management has approved exemptions under the Heritage Act to make these types of decisions", the spokesman said.
